HOA Risk Exposure Report Platform (coveryourassetsconsulting.com) The HOA Risk Exposure Report is an AI-powered advisory tool that analyzes uploaded HOA governing documents and insurance policies to identify potential coverage gaps, policy misalignments, and areas of exposure. Reports are generated using artificial intelligence and Shelby Hayes's proprietary methodology. Reports include, depending on documents uploaded and plan selected: - Board Report with coverage gap analysis - Unit Owner Summary - Deductible Gap Analysis - Individual Unit Review (when unit owner dec pages are uploaded) - Insurance Structuring Guide B. In-Person Advisory and Consulting Services (thecoverageconsultants.com) In-person services include policy structure reviews, governing document analysis, board education workshops, homeowner policy sampling, and annual advisory retainers. ADVISORY NATURE OF ALL SERVICES — CRITICAL LIMITATION [This is the most important section. Specifically: - No service or report constitutes legal advice or a legal opinion - No service or report constitutes a coverage determination — only your insurance carrier can determine whether a specific claim is covered under a specific policy - No service or report constitutes financial advice - Reports are risk reduction tools, not risk elimination tools - Findings are based solely on the documents provided and may not reflect the complete state of your insurance program - Statutory citations are provided for reference and should be verified with qualified legal counsel before reliance - Recommended CC&R and bylaw amendment language is a starting point only and must be reviewed by licensed HOA legal counsel before adoption - Policy type determinations (HO-3, HO-6, etc.) should be verified with a licensed insurance agent before changing existing coverage The Coverage Consultants is not a law firm and does not practice law. DOCUMENT ACCURACY AND CURRENCY The accuracy of your report depends entirely on the accuracy and currency of the documents you upload. You represent that: - You have the legal right to upload and submit the documents provided - The documents are the most current versions available to you - You understand that analysis of outdated documents may produce findings that do not reflect your current coverage We are not responsible for findings based on inaccurate, incomplete, or outdated documents you provide. ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ 5. PAYMENT AND REFUND POLICY One-Time Analysis Payment is due at the time of purchase. Because reports are generated and delivered digitally upon purchase, all sales are final except in the case of technical failure. Technical Failure Refunds If our system fails to generate a report after multiple automated retry attempts, you are entitled to a full refund. Contact us at Shelby@thecoverageconsultants.com within 7 days of your purchase. Refunds for verified technical failures are processed within 1-2 business days. Subscription Plans Annual Monitoring and Property Manager subscription plans are billed monthly or annually as selected. Subscriptions may be cancelled at any time; cancellation takes effect at the end of the current billing period. INTELLECTUAL PROPERTY The HOA Risk Exposure Report generated for your community is provided for your use in managing that community's insurance program. You may: - Share your report with your HOA board, property manager, insurance agent, or attorney - Use your report for internal decision-making and board documentation - Distribute the Unit Owner Summary to members of your community You may not: - Resell or commercially distribute reports generated by our platform - Represent our reports as your own original work product - Use our platform to generate reports for communities you do not represent - Reverse engineer or systematically extract our analysis methodology The Coverage Consultants methodology, report structure, and platform are proprietary. © 2026 The Coverage Consultants. LIMITATION OF LIABILITY To the maximum extent permitted by applicable law, The Coverage Consultants and Shelby Hayes shall not be liable for: - Any coverage decisions made or not made based on our reports - Any insurance claims denied, disputed, or underpaid where our analysis was relied upon - Any special assessments, financial losses, or legal costs arising from gaps identified or not identified in our reports - Any losses arising from reliance on statutory citations without independent legal verification - Any indirect, incidental, consequential, or punitive damages of any kind Our total liability to you for any claim arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim. ━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━━ 10. GEOGRAPHIC RESTRICTION Our platform is intended for use by individuals and organizations located in the United States. GOVERNING LAW AND DISPUTE RESOLUTION These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.
